Welcome to Passionate Creatives | Studio, operated by Passionate Creatives LLC. By using our website, booking a consultation, purchasing a service, submitting payment, or engaging Passionate Creatives | Studio for creative services, you agree to these Terms of Service.

Our Services

Passionate Creatives | Studio provides creative services that may include branding and brand identity, graphic design, marketing materials, social media and digital content, publishing design and formatting, creative strategy, commercial and video production, AI-assisted creative production, and related services.

Specific deliverables, pricing, timelines, revision allowances, and project requirements may vary. The terms contained in an individual proposal, invoice, contract, or service agreement will apply to that particular project.

Vision Conversation™

Certain projects may begin with a Vision Conversation™ to discuss the client's goals, audience, creative direction, project requirements, and overall vision.

A Vision Conversation™ does not guarantee project acceptance or availability.

Pricing and Payment

Prices displayed on the website represent current rates or starting prices and may change as services evolve.

Services identified as “starting at” require a customized quote based on project scope, complexity, timeline, number of deliverables, production requirements, and other project-specific factors.

Work will not begin until any required payment, deposit, approval, or project materials have been received.

Clients are responsible for paying invoices according to the payment schedule provided for their project.

Project Scope

The services and deliverables included in a project will be identified before production begins.

Requests outside the agreed-upon scope may result in additional charges and may require a revised timeline.

Significant changes in direction after a concept has been approved may be treated as a new request rather than a revision.

Client Responsibilities

Clients are responsible for providing accurate project information, text, names, dates, logos, photographs, brand assets, manuscripts, business information, and any other materials necessary to complete their project.

Clients are also responsible for reviewing proofs carefully before providing final approval.

Passionate Creatives | Studio is not responsible for errors contained in information or materials supplied or approved by the client.

Revisions and Approvals

Revision allowances vary by service and will be stated in the applicable service description, proposal, or project agreement.

Additional revisions may be billed separately.

Once final approval is provided, additional changes may require a separate fee.

Turnaround Times

Estimated turnaround times begin after all required payments, information, content, and client materials have been received.

Turnaround estimates are not guarantees unless a specific deadline has been agreed to in writing.

Delays in client feedback, approvals, content submission, or requested changes may extend the completion date.

Rush Services

Rush and expedited services are subject to availability and additional fees.

Payment of a rush fee provides priority scheduling but does not remove the client's responsibility to provide timely approvals, information, and materials.

Intellectual Property and Ownership

Unless otherwise stated in writing, Passionate Creatives LLC retains ownership of preliminary concepts, rejected designs, working files, production methods, templates, and unused creative materials.

Upon full payment, the client receives the rights specified for the final approved deliverables in the applicable agreement or service description.

Editable files, source files, working files, templates, or production files are not automatically included unless specifically identified as part of the purchased service.

Clients may not resell, redistribute, reproduce, claim authorship of, or commercially exploit materials beyond the rights granted to them.

Client-Provided Materials

By providing photographs, logos, fonts, illustrations, music, manuscripts, written content, trademarks, or other materials, the client represents that they own the material or have permission to use it.

The client is responsible for obtaining appropriate permissions and licenses for materials supplied to Passionate Creatives | Studio.

Third-Party and Licensed Materials

Some projects may incorporate licensed fonts, stock assets, music, software, artificial-intelligence tools, or other third-party resources.

Those materials may remain subject to the licenses and terms of their respective owners.

AI-Assisted Creative Production

Passionate Creatives | Studio may use artificial-intelligence-assisted tools as part of certain creative workflows, including concept development, visual production, editing, writing assistance, ideation, and cinematic production.

AI-assisted services are used as creative tools within a broader human-directed production process. Because third-party AI platforms and technologies may change, exact outputs cannot always be guaranteed or replicated.

When a project requires special confidentiality or restrictions regarding AI-assisted tools, clients should communicate those requirements before production begins.

Portfolio and Promotional Use

Unless otherwise agreed in writing, Passionate Creatives | Studio may display completed public-facing work in its portfolio, website, social media, advertisements, case studies, presentations, or promotional materials for the purpose of demonstrating its services.

Confidential, unreleased, or sensitive client information will not intentionally be published as portfolio material before it becomes public.

Clients who require their project to remain private should request a confidentiality arrangement before work begins.

Communication

Clients are responsible for providing current contact information and responding to requests for feedback, approvals, and project materials within a reasonable period.

Extended periods of client inactivity may delay or pause a project. Projects that remain inactive for an extended period may require rescheduling or reactivation under current pricing and availability.

No Guaranteed Business Results

Creative services are designed to support branding, communication, marketing, and presentation goals. However, Passionate Creatives | Studio does not guarantee specific sales, revenue, audience growth, publishing results, social-media performance, engagement levels, or other business outcomes.

Website Use

Website content, branding, graphics, written material, service descriptions, layouts, photographs, and original creative material belonging to Passionate Creatives LLC may not be copied, reproduced, distributed, or commercially used without written permission.

Limitation of Liability

To the fullest extent permitted by applicable law, Passionate Creatives LLC will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the use of this website or our services.

Any liability related to a paid service will be limited to the amount paid for the specific service giving rise to the claim, to the extent permitted by applicable law.

Governing Law

These Terms of Service are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

Changes to These Terms

Passionate Creatives LLC may update these Terms of Service as the business, website, or services evolve. Updated terms will be posted on this website with a revised effective date.
